This Receiver Hosting Agreement ("Agreement") is between DroneSight ("DroneSight," "we," "us," or "our") and the individual identified on the corresponding host application (the "Host," "you," or "your"). It governs your participation as a volunteer host of a DroneSight receiver ("Receiver") as part of the DroneSight network. By submitting your host application and address information, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
DroneSight operates a volunteer-powered network of Remote ID receivers that detect drone activity in the areas surrounding each Receiver. As a Host, you agree to install and maintain a Receiver at your property so that it can operate as part of this network.
The Receiver is provided to you at no cost, for your use solely as part of the DroneSight hosting program. The Receiver remains the sole property of DroneSight at all times. Nothing in this Agreement transfers any ownership interest in the Receiver, or in any related hardware, software, or documentation, to you.
As a Host, you agree to:
You agree to take reasonable care of the Receiver while it's in your possession, the same care you'd take of your own similar property. Ordinary wear and tear, and failures caused by a defect in the Receiver itself, are DroneSight's responsibility, not yours.
DroneSight may request that you return the Receiver at any time, for any reason, with at least 14 days' notice. If we ask for it back, we will provide a prepaid shipping label and any packaging instructions needed, at no cost to you. You agree to pack and ship the Receiver back to us within 14 days of receiving the prepaid label.
This Agreement, and your right to possess the Receiver, ends automatically if you stop hosting the Receiver, ask to leave the program, or fail to return the Receiver as described above.
There is no cost to you to participate, and DroneSight does not pay you to host a Receiver. Hosting a Receiver does not make you an employee, contractor, partner, or agent of DroneSight.
DroneSight is a volunteer, community-hosted network. Receiver performance depends on factors outside our control, including your installation, power and internet connectivity, local radio conditions, and other network factors. DroneSight does not guarantee continuous or error-free operation of the Receiver, or that data detected by the Receiver will be collected, transmitted, or delivered to any end user, customer, or other third party.
You agree that DroneSight and its officers, employees, and agents will not be liable for any loss of income, revenue, profits, business opportunity, or other damages arising from any failure, interruption, delay, or inaccuracy in the Receiver's operation, or in the collection, transmission, or delivery of data.
This section limits your ability to hold DroneSight responsible for certain injuries, damages, or losses. Please read it carefully.
You understand that hosting a Receiver means installing and keeping a small electronic device connected to power and the internet inside or around your home. To the fullest extent permitted by law, you release, waive, and forever discharge DroneSight and its officers, employees, and agents (collectively, the "Released Parties") from any and all claims, liabilities, damages, losses, or expenses — including property damage and personal injury — arising out of or related to the delivery, installation, presence, use, or removal of the Receiver at your property, except to the extent caused by the Released Parties' gross negligence or willful misconduct.
You agree to indemnify and hold the Released Parties harmless from any third-party claims arising from your installation or use of the Receiver in a manner inconsistent with this Agreement or the setup instructions we provide.
The Receiver is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, the Released Parties will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to this Agreement or your participation as a Host, even if advised of the possibility of such damages. The Released Parties' total liability arising out of this Agreement will not exceed the replacement cost of the Receiver.
Information collected in connection with your participation as a Host, and information processed by the Receiver itself, is handled as described in our Privacy Policy.
This Agreement begins when you submit your host application and continues until either you or DroneSight ends your participation in the hosting program. Either party may end your participation at any time, for any reason, by notifying the other. Sections 2, 5, 7, 8, 9, 10, and 13 survive termination of this Agreement.
Governing Law. This Agreement is governed by the laws of the State of Ohio, without regard to its conflict-of-law principles.
Entire Agreement. This Agreement, together with our Privacy Policy, is the entire agreement between you and DroneSight regarding your participation as a Host, and supersedes any prior or contemporaneous understandings on that subject.
Severability. If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full effect.
Assignment. You may not assign or transfer this Agreement. DroneSight may assign this Agreement in connection with a merger, acquisition, or sale of assets.
Changes. DroneSight may update this Agreement from time to time. If we make material changes, we'll update the "Last updated" date at the top of this page.
